Failed transfer viva, still want to do a phd

Hello, please could someone give me some advice regarding the situation I am in?

I reported supervisor for fraud, and said I wanted to change supervisors, and that if this could not happen I would quit. I was told I would have a transfer viva, and that my issues could be discussed afterwards. I completely failed the viva. However, the viva was rather odd; my actual project was barely discussed (literally no discussion of my results, about a minute discussing the methodology). All three post-docs in the group say I'm capable of doing a PhD and that I'm being pushed off; until I reported him for fraud, my supervisor had been very complimentary about my work.

My industrial supervisor and one of the viva examiners also say I capable of doing a PhD. Both have said they will give me references stating this. They have also assured me that this situation is not my fault. However, they refuse to get involved in any disputes in the department, and made it clear their comments are "off the record". I do not know how much they will elaborate to much on the current situation in any references they give. Furthermore, my industrial supervisor is often impossible to get hold of, and has not provided the references they've been asked for.

Nothing happens when I file formal complaints. I've been denied the opportunity to re-sit with different examiners, and have been refused feedback on my transfer report. One of the post-docs actually went to complain to the head of section (I did not ask him to do this), but this had no effect.

Is it realistic to get a PhD when I already have an MPhil? I am relatively old to be starting a PhD (26). I do not care about being a doctor, but do want to have a career in research (although I do not want to go into academia), and fear this will be impossible without a PhD. I'd really appreciate any advice anyone has. Thanks
